If a train is going east at 50 mile per hour and the prevailing winds are to the east at 10 Km per hour and you throw a cigarette but out the window. Should you be charged with smoking on public transit or littering.

You didn't define what kind of train it was, freight or passenger... And your spelling teacher also gets fired...
The cruiseship I was on had a sign on deck saying "note from the captain: If you throw a butt off my ship I throw a butt of my ship" so I really wouldn't worry that much about getting arrested ^^'
