The law is too confusing and there shouldn't be a well if you have this much you are kinda bad and will lose your license for a few days, but if you have this much you are really bad and can go to jail. They need a clear line of what is the limit and should stick to it.
Excuse me but isn't that what we have with the .05 and .08 levels, ie .05 and you are kinda bad and .08 you are really bad? Now we can argue what the levels should be and what the penalties should be. From growing up in an era when it was socially acceptable to drink and drive we've come a long way baby. If there was as much drinking and driving now as 40 years ago with all the extra traffic on the roads it would be like a middle east war zone on our highways. There were many times, and I'm not proud of it now, that I have no idea how we got home from road trips into New York State on many weekends.
