tax confusion

Just got back from a great trip to Atlantic City NJ

Played in a tournament at the Borgata. Finished in the money and was supposed to get back around $300. But had 30% "withholding tax" deducted from my winnings because I'm from Canada.

Played a tournament the next day at Harrah's. Before the tournament I told them about my tax deduction at the Borgata. They told me the Borgata was wrong and no tax should have been deducted - only if I had won over $5,000.

So who is right?

I know that Seneca Niagara in Niagara Falls, NY takes 30% off Canadians.
What about Vegas? What about other states?

  • Interesting, I wasn't aware of any US casino doing the 30% withholding for less than a $5K. win other than Seneca.. I had three tournament cashes (largest $740.) in AC in March with no withholdings, however none were at the Borgata.... As Canadians that is definitely one of the things we should consider, and ask about, when we plan on playing any tournaments in the US.

  • The standard withholding rate for everyone is 30%.

    If the US has a tax treaty with a country you can get reductions for things like dividends and interest payments. 30% is the default rate though.
