My understanding is that any proceeds you keep from a home game is considered a rake even if there's a chance that eventually you could pay it all back, because that may never happen. I would say that you'd be taking a risk to do it.
Why take the risk of having legal problems? It's probably much safer to not have a bad beat jackpot. Plus if you're a good player you're at war with variance.
BBJ in a home game? I read somewhere that the chances of hitting a bad beat jackpot (quads +) is like 200,000 to 1. That's a lot of home games before someone hits the pot. I hope you keep the funds aside as it might be a big hit to your bankroll. Personally, I think BBJ are a scam and try to avoid clubs that have them.
Personally I think the chance that cops bust that home game is about the same as somebody winning the bbj. Unless its some bigger gathering/operation.

If you give away all the money at the end of the night, probably no issue as no rake really. If you carry it over to another night, probably an issue. With all the clubs in the GTA, why even worry about it.
