legal question

Just joined today and have a question. Our shall I say establishment (private club) had run poker for several years. The members have just voted to stop the games. We had everyone sign a document that stated they did not pay to play poker and that they would not win a prize for playing poker. The documant stated that their name was in a draw to win prizes. We have a lottery license to do this. (everyone knew that they paid to play poker and that there was winners.
I see that a lot of places advertise games etc. Anyone have any feed back for us? What do you think of the signed documents?

  • Anything you get here will strictly be opinion. Your best bet is to contact a lawyer.
  • I agree with Wes on this one, the topic may have been covered on the site before, but it is probably coming from someone with no legal background. I understand lawyers are expensive, but if your business relies on it, it is probably worth paying for some concrete information.

  • Thanks everyone. We have had a legal opinion. They tell us that any game that allows a profit to be made via the game, a bar or food sales is not legal. Note the mention of any game. We have been told that this would include cribbage, euchure etc.
    Any way we have not had the chance to test my draw documents in court and doubt that we will at any time.

  • Wow...thats pretty suprising. So you can't organize a soccer / hockey / baseball game where the two teams play for money then either?
  • just keep it under wraps and you should be fine; even if it got busted, your probably looking at a small fine. Most clubs that get busted are reopened the next day and life goes on. A lot of clubs are being more careful these days but there seem to be just as many before the crackdown so its really a losing battle for the authorities.
  • There may be a way around it also if you donate a portion to charity...not sure, just a thought.
  • As far as our solicitor was concerned, sec 185 of the Criminal Code deals with gaming and gaming houses and no specific type of game is indicated. It does not state only games of chance either, thats why they told us any game.
    I have to think that no authority will attempt to paste an organization for cards or other games as long as things are done with some reasonablness.
