  • The requirements for a Police officer to enter your residence (home) are a lot higher than a hall or commercial building. The following must be met for them to enter a residence without a search warrant:

    1. They must be in "hot pursuit" of a fleeing suspect or
    2. They have your consent to enter your residence or
    3. They have grounds to arrest a suspect believed to be at the residence.
  • It's been a while since anyone posted in this thread..Just wondering if there is any new news on what constitutes a legal poker game in a bar. As I posted here I hold a tourney bi-weekly. I don't rake but we all throw $10 into the kitty and divide 50/30/20% at end 1st/2nd/3rd.

    There have been undercover cops actually playing in this game I am sure. They did not bust us but I guess it can happen. Are they liable to come after us? We had 27 players last weekend so thats only $270 in the winning pool.

    I myself would like to think that the police have more pressing matters to concern themselves with.......but unfortunately they don't.

    Once this mandatory sentencing thing really kicks in, most people will be locked up, and then they'll really be looking for something to do.

  • I think he has me on ignore, but this IS a thinly veiled personal attack on a couple forum members, coming from someone who knows Kitchener, as BigE certainly does.

  • someone should give the guy who runs all these raids a call (from the OPP) to see what gives. Its seems to be the same officer running this task force. Maybe Graham you could give him a call as a representative of Canadian poker community? They haven't raided any new place since early winter. So they are likely getting ready for another round or it was a one time binge. I go to plenty of clubs in the city and none really seem that concerned. It would be interesting to ask him directly if any future raids are immanent to see his reaction.

    Although I think that his jail time was more for being a bookie than the poker.


    BTW, I think the next raids will come in Sept/Oct before the WPT Niagara, just like last year.

    The problem is that it's worth it to take the risk of getting caught.

    The police staked out The Shop for atleast 2 months before raiding it. How much money do u think was brought in during that time period? My guess is about $40 000 to $50 000. The three busts that I've heard people involved in talk about, nobody gots more then community service and a $5000 - $10 000 fine.

    Does anybody know of someone going to jail for running a common betting house in canada?
  • Ok, first of all I highly doubt they brought in that much money. If they did, good for them, I just doubt it.

    Secondly, I'm not sure how many people would give up their 'clean record' and ability to get a job/cross the border etc. for a one time score of 40-50K.

    Thirdly, I think you also have to consider the stress it puts on loved ones knowing that the business you run could find you in court one day. You're also pegged by the police once you get caught, it becomes that much more difficult to do anything even if it is on the up and up.

    I would be interested to know if the owners of the shop or other places that have been busted, if they had the chance, would make alternative choices. Just something I'm interested in, not expecting an answer here at least....

    No I do not have you on ignore Kristy, although I do find most of your posts not my style I choose to simply not click on them or read them and this is not a personal attack on anyone, I respect your poker abilities and love the challenge of playing you, the fact that I don't agree with everything you write does not mean I harbour a grudge or a dislike. My personal feelings or impressions of people are a separate thing. I certainly can like someone and still shake my head and wonder why they would take such a chance. I am sorry but I think 'stupid' fits in this case.

    Regardless of WHO shows up or plays in these rooms the fact remains it is against the law. So I am sorry whether you are someone I know or a complete stranger you still deserve the punishment. What's the old saying? "If you can't do the time, don't do the crime". I also would never visit these card rooms either because I just cannot afford to do the time.

    For the love of God people RESEARCH before you shoot off.. if one were found in such a place it is a FINE not jail time, and this is another example of our parentally modelled government spanking us. I'm tired of people, good people with reasonable intentions and expectations being penalized because the lion's share of the population are morons who lack the discipline.

    As Mark says...it is a shame that stupid doesn't hurt, but it won't be me with the ice cream headache in this instance Eric.

    umm, you lost me here, please elaborate? I do not belive I have posted any inflammatory remarks or unsubstantiated claims. I believe I have only posted my personal thoughts on an issue? In fact I tried to make the point that it should not matter who is involved here, I seperate myself from that and simply believe that doing anything that is illegal is a risk and if you take that risk and get caught you really need to accept that and hopefully learn from it. I do not wish it on anyone but if it happens you certainly will not get my sympathy. So what exactly are we arguing about here?
