pokerforum.ca threatened with libel suit

wow.

we got an email today from a lawyer...I think it's the real deal. Is there a cpf lawyer member in da' house?

    I don't know of a lawyer that would send an email and threaten a libel suit since it's fairly easy to get the info on the actual owner of the domain.
  • What kind of lawyer would not use registered mail with proof of receipt and instead send an email that could easily go unread in the Spam folder? What's the libel allegation? Did somebody call him a donkey? ;)

  • that's a good point...but there was a pdf attachment outlining the complaint from a London UK office, the email domain checked out too. Meaning it was sent from person@lawfirm.com so i visited the domain, and it is indeed a law firm.
  • Not knowing the context of the suit, I would have to say it was a bogus spam email. I would ignore it. It's too easy these days to set up a phoney company on the web and try to rip people off. I wouldn't give it a second thought.

    Did it name anyone in particular? If not, that's another reason to ignore it.

    Besides, nothing said in this forum can be taken too seriously. We're all peace loving, card playing, tolerant Canadians...who in England can say anything bad about us??

    I think sending a quick message to this guy is prudent for several reasons. First, just to verify that we weren't the only ones on this guys' list. Secondly, get sound advise.

  • Cmon. To pay some lawyer in the UK, to file suit in a Canadian court would cost soo much $$$ it couldn't possibly be worth it unless the dude figures he has lost hundreds of thousands of dollars due to the libel.

    You are being phished. Ignore it and wait for the registered letter.

    I'll bet 33 cpf $$$ if you google "scam lawfirm.com" you will get tons of hits.

    V0id had it coming...this ambulance chaser, if he IS for real, is just using scare tactics to warrant his fees.

    I would encourage we use the Free Speech and Public Forum cards and refuse this absurd request from this guy.

Their issue is surely with Pokerstars and good luck to them there... So she's saying that she didn't play the account, it was her brother? lol, either way good luck ambulance chaser....

  • Holy freakin' conspiracy theories over at 2+2, and people wonder why the AP thing took so long to get credibility. One thread gets pulled and the speculations run WILD!!!

    My 2 cents, remove the original link to the story (especially since it doesn't exist any longer), and that should satisfy the lawyers.

    Typical Cease and Desist I've seen a few times for online content.
  • This is stupid, but they have a legit claim. Web content can be tried under the jurisdiction under which it is viewed (not just where it's hosted). Check out http://www.dba-oracle.com/internet_journalism_libel_laws.htm but basically:
    Posting comments on the internet is akin to writing the same comments to the letters page of every major national newspaper in the world. The international scope of blogs mean that claims in any country are possible - territorial limits are a thing of the past.

    Bloggers must also be aware of their responsibilities as hosts of discussions where comments are invited from readers. Any defamatory comments made in other posts on the blogger's website may result in the blogger being held responsible for those comments and being sued for libel.

    Defamation legislation gives a defence where the 'publisher' (the blogging host) has no knowledge of the defamatory remarks or no reason to suspect the remarks have been made. This gives some protection to Internet Service Providers (ISPs) but very little comfort where the blogger has read and accepted comments on his/her blogging pages.     wow i seriously can't believe this crap. this is worse than pokerstars threatening to suspend players who use ranking sites. where are the laws protecting the posters in this scenario? i hardly feel like one should be liable for merely attaching a link to another article in a forum.
  • Just remove the link and you will be fine. Other than that they have no case. The law firm trolled the internet to find any reference of the WCOOP as they are building a case. Its a textbook move to gather evidence in what seems to be an attempt to save face for the specific "user" involved. They already know they aren't going to win the disqualification battle, so they are going for civil damages.
