To jontm (or Pokernews), do you know why Morden "Cookie"
Lazarus chose the new charity as the Jodi
Lazarus Fund for Hereditary Breast Cancer? Mrs. Jodi Lazarus lives in the same address as Morden so I assume that is his wife? Is the Jodi Lazarus Fund a registered charity, and are any of his relatives employed or benefiting from it? Has the name of the charity associated with the Montreal PartyPoker Classic been changed to JTL-BRCA to try to avoid the apparent conflict of interest?
I had thought FTP took the $412,500 in buy-ins while the Miriam Foundation got the rebuys and add-ons (~2,700 totalling ~$340K?), but it turns out that Miriam kept the entire $750K+. If Cookie is correct that "the law of Quebec, as contained in Article 1443 CCQ is very clear on this point" (see below), then Miriam should pay the 2011 winners from its $750K proceeds.
"1443. No person may bind anyone but himself and his heirs by a contract made in his own name, but he may promise in his own name that a third person will undertake to perform an obligation, and in that case he is liable to reparation for injury to the other contracting party if the third person does not undertake to perform the obligation as promised."
Miriam can then stand in line with the rest of FTP's victims in trying to recover $200K+.
